Twizzr Terms of Usage

By using Twizzr platform (Website, Twizzr App and Twizzr-Merchant App), you agree to comply with these Terms. Please stop using the platform if you disagree with any provision.

The following terms help clarify how we describe the Service and the people who use it.

Use the Service only for lawful purposes. Avoid harassing other users, sharing offensive content, or disrupting normal Platform operations. We may remove content or restrict access that violates these guidelines.

All content, trademarks, software, and design assets within the Platform belong to or are licensed by EL NOVA LABS. You may not copy, distribute, or adapt these assets without written consent from us.

Any similarity with our products or services is coincidental or unintentional or general accepted practice. EL NOVA LABS is open for discussion and negotiation for any similarity with our products or services.

You are responsible for safeguarding your login credentials and for all activity under your account. Provide accurate information and update it as needed.

Our Privacy Policy governs how we collect and use personal data. Please review it to understand how your information is handled.

We may suspend or terminate access to the Platform without notice if you violate these Terms. After termination, your right to use the Platform ceases immediately.

EL NOVA LABS is not liable for indirect or consequential damages arising from your use of the Service, including data loss, business interruption, or unauthorized access to data and content.

Twizzr is a platform owned and operated by EL Nova Labs.

It connects local merchants with nearby customers, enabling online listing, order placement, and booking of goods or services.

The platform includes (a) Web Portal: https://twizzr.in , (b) Twizzr-Merchant App, and (c) Twizzr Customer App.

Twizzr only provides a digital interface for interaction between merchants and customers.

All transactions take place directly between merchants and customers.

Twizzr does not act as a seller, payment intermediary, delivery service, or guarantor of product/service quality.

Twizzr does not charge merchants or customers for registration, listing, or platform use.

Any delivery fee or service charge is solely determined by the merchant. Twizzr has no role in fixing or collecting such charges.

Orders and bookings initiated through Twizzr are strictly "Cash on Delivery."

Merchants must ensure completeness and accuracy of delivered items or rendered services.

Customers must verify goods or services at the time of delivery before making payment.

Twizzr is not responsible for incomplete, incorrect, or defective deliveries.

Twizzr is not involved in collection, transfer, or settlement of payments.

Any disputes regarding payments, refunds, or delivery quality must be resolved directly between merchant and customer.

Twizzr will not mediate or be held liable for financial or transactional conflicts.

All terms applicable to product orders also apply to service bookings.

Quality, timing, and professionalism of services are the sole responsibility of individual merchants.

Twizzr does not guarantee availability, satisfaction, or outcomes of services booked through the platform.

To facilitate order and delivery communication, Twizzr shares necessary contact and address details between merchants and customers.

Usage of shared contact information must be limited to the respective transaction and comply with local data protection norms.

This sharing is mandatory for platform functionality and non-optional for both parties.

Twizzr does not favor or promote any specific merchant, product, or service.

Listings may appear based on randomization, alphabetical order, ratings, activity levels, or other system-driven criteria.

Twizzr reserves the right to modify display algorithms at any time to improve platform performance or user experience.

Apartment or locality registration on Twizzr is managed objectively by the platform team.

Requests are processed on a first-come, first-served basis through a waitlisting mechanism.

Twizzr maintains neutrality and does not prioritize any locality or merchant.

Merchants are fully responsible for the quality, authenticity, and legality of products and services displayed or delivered.

Customers must exercise due diligence before placing or accepting any order or booking.

Twizzr is not liable for expired, defective, unsafe, or misrepresented goods or services.

Twizzr assumes no responsibility for safety incidents, misconduct, or disputes arising between merchants and customers.

Twizzr does not provide any delivery personnel or logistics services.

Delivery and pickup arrangements are solely managed by merchants and customers.

Merchants and customers are expected to interact respectfully and comply with all applicable laws and community guidelines.

Abusive behavior, fraudulent listings, or misuse of contact information can lead to suspension or account termination.

Twizzr adheres to reasonable data protection principles but holds no responsibility for misuse of shared information by third parties.

Twizzr reserves the right to modify or update these Terms of Usage at any time.

Users (both merchants and customers) will be notified through app or website updates regarding significant changes.

Twizzr is not liable for any financial, reputational, or material losses resulting from use of the platform.

The platform is provided "as is" without any warranties, express or implied.

Merchants represent and warrant that they are the legal owners or authorized resellers of all products listed on the platform. Merchants must ensure that all products sold are genuine, authentic, and free from defects, and that they possess valid invoices and licenses as required by law (e.g., FSSAI, BIS).

Twizzr respects intellectual property rights. If a brand owner or authorized representative believes any listing infringes upon their trademark or copyright, they must submit a formal complaint with supporting documentation. Twizzr reserves the right to immediately suspend or remove listings and merchant accounts found to be in violation of IP laws, without prior notice or liability to the merchant.

Merchants are solely responsible for obtaining and maintaining all necessary government licenses, permits, and registrations required to sell their products offline and online (including GST registration, Trade License, FSSAI registration for food items, etc.). Upon request by Twizzr or regulatory authorities, merchants must provide proof of compliance.

Merchants are responsible for accurately listing all mandatory product information as required by the Legal Metrology Act, 2009, and the Consumer Protection (E-commerce) Rules, 2020. This includes displaying the maximum retail price (MRP), date of manufacture/expiry, net quantity/weight, and country of origin for all packaged goods.

These Terms are governed by the laws of Uttar Pradesh, India. If any provision is deemed unenforceable, the remaining provisions stay in effect.
